Data Controller

The Data Controller of all necessary data obtained from potential employees during the recruitment process is Nordweld Sp. z o.o., headquartered in Gorlice, at: ul. Przemysłowa 3, 30-300 Gorlice (hereinafter “Nordweld,” “Company,” or “Controller”).
Nordweld
, as the Data Controller, processes the data of job applicants for all positions, which have been provided to the Company through any accepted recruitment channels and during the entire recruitment process.

Scope, Purpose, and Legal Basis for Data Processing by the Company

The basis for data processing by the Controller is the applicable law, primarily Article 221 §1 of the Labor Code, as well as provisions of other executive acts. In cases where the data scope is broader than defined by these provisions or for the purposes of future recruitment processes, your consent is required.
In connection with the recruitment process, the Company may process the following data:

  • Identification data (name, surname, date of birth),
  • Contact details,
  • Information on education,
  • Details of previous employment,
  • Professional qualifications,
  • Other data necessary for the recruitment process, provided that data listed in points 3) to 6) will only be processed if necessary for performing work of a specific type or position.

The data obtained during the recruitment process is processed for the following purposes:

  • Reviewing the candidate’s application for a specific position offered by the Company (Article 6(1)(c) GDPR);
  • Conducting the recruitment process (Article 6(1)(c) GDPR) and, upon consent, also for future recruitment processes (Article 6(1)(a) GDPR);
  • In a limited scope, exercising the right to defend against claims or pursue claims (Article 6(1)(f) GDPR).

Providing data is voluntary but necessary to carry out the recruitment process and establish potential further cooperation.

Retention Period for Personal Data

Personal data obtained during the recruitment process will be retained for the purposes mentioned above for the duration of the recruitment process. In cases where the candidate consents to participate in future recruitment processes, the data will be processed until the consent is withdrawn, but no longer than 12 months. In a limited scope, personal data will be stored until the statutory limitation period for potential claims expires.

Recipients of Personal Data

The Company reserves the right to share personal data processed during recruitment with entities supporting the recruitment process and service providers, such as IT services or other necessary services essential for the Company’s operations.

Transfer of Data Outside the European Economic Area (EEA)

The Company does not transfer recruitment data outside the European Economic Area (EEA). However, an exception may apply to candidates whose applications are submitted via the Pracuj.pl portal, which uses providers located outside the EEA. In this case, as stated in the privacy policy of Grupa Pracuj.pl, personal data may be transferred outside the EEA. Such transfers are conducted under standard contractual clauses adopted by the European Commission or participation in the “Privacy Shield” program established under Commission Decision (EU) 2016/1250 of July 12, 2016, on the adequacy of protection provided by the EU-U.S. Privacy Shield.

Job Applicants’ Rights Regarding Data Processing

In accordance with applicable regulations, you have the following rights regarding the personal data provided to the Company during the recruitment process:

  • Right to access data;
  • Right to request data rectification, deletion, or restriction of processing (exercising this right may result in the premature termination of the recruitment process);
  • Right to object to processing (exercising this right may result in the premature termination of the recruitment process);
  • Right to data portability to another controller (applicable only where the basis for processing is contract performance or your consent).

If the processing of data is based on your consent, you have the right to withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
